Yogift.com operates a website which provides a service enabling gifted members who have the technique and ability to audition, upload their portfolio, showcase their gifts at their own pace and style not forgetting talented pets.
Yogift.com creates an opportunity for both talented members to be noticed or Audition their talents or gifts to Recruitment Agencies or Business Organisations such as Music production companies, Talent recruitments shows or companies, Talent search Agencies, Sports, artists, Pets with talent shows or competitions, television production companies, advertising agencies, Academic institutions, theatres , event promotion companies and other Agencies not mentioned operating in the entertainment industry, academic industry, sporting industry, Pets & Animals with talent and the list goes on to place contest recruitments or advertisements, classified advertisements .
Recruitment Agents or Business Organisations may choose to search member profiles, view member profiles and contact members directly through our website send mail feature or place advertisements, and Yogift.com member applicants may choose to apply to such advertisements or reply to the email received from Agents or Business organisation. Yogift.com will allow members to view Agents or Business Organisations profiles so that members can get or read all details of the Agent or Business organisation that sent them an email or placed the advertisement.
Subscribers to membership of Yogift.com can choose to make their personal information, Videos, photos and portfolio public, contact and receive contact from other members of Yogift.com.
By making your profile public, you acknowledge that any internet user visiting or registered member of Yogift.com may view your profile, including all details you have posted. Making your profile public will also make your profile accessible from search engines such as Google. We advise you to make yourself familiar with our safety tips.
Yogift.com is not responsible for the content, and makes no warranty as to the accuracy of the advertisements and contests. Members should always use their own judgement in deciding whether or not to apply for any of the roles, contests, talent recruitment programmes, events, music, e.t.c advertised on Yogift.com. We provide our service only for the purposes of Members show casing their unique ability talent their way, their style and own pace. Yogift.com is a website for exclusively talented members and we present the opportunity for subscription members to audition, cast, and enter contests auditions with third party advertisers. We shall not be liable under any circumstances for the actions of any advertiser of any role featured on this site.
Yogift.com is not responsible for the content, and makes no warranty as to the accuracy of Members’ personal information. Advertisers should always use their own judgement in deciding whether to contact members through email, cast, recruit or audition members. We shall not be liable under any circumstances for the actions of any Member.
Agents or Business organizations on Yogift.com Submitting a contest, a classified advertisement, casting calls, modelling or any talent search advertisement ,contacting members through Yogift.com email feature will need to use your agents or business name, a contact name, website address, email, logo and business registration address include location as our rules and regulations. Breach of this requirement will result to termination of Agents or Business organization membership. If membership is terminated due to breach of our terms and conditions no refund will be given or returned.
Liability
You agree that, to the maximum extent permitted by English law, any and all liability and responsibility of Yogift.com to you or any other person under or in connection with these terms and conditions, or in connection with the services, this web site, another member's acts or omissions, or your use of or inability to use, the services or this web site is excluded regardless of whether such liability arises in contract, tort (including negligence), equity, breach of statutory duty or otherwise. Yogift.com’s liability and responsibility is excluded in respect of any and all loss or damage, whether direct or indirect, including, without limitation, loss of profits, loss of data, loss of business or anticipated savings, general and special damages, and consequential and incidental loss.
Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct or indirect loss or damage arising under these terms of use or in connection with our website, whether arising in tort, contract, or otherwise. Breach
Without limiting any other rights and remedies available to Yogift.com, we may limit your activities on the web site, remove your advertisements, remove your profile and files, issue a warning to you, suspend or terminate your membership, or refuse to provide our services to you if you breach these terms and conditions or where Yogift.com considers it appropriate.
Responsibility for minors by Guardians or Parents
This site is intended for persons aged 17 or over. You acknowledge that some parts of Yogift.com site may contain material that is inappropriate for minors. Minors who access Yogift.com are required to be supervised by a parent or guardian at all times. Minors are not permitted to upload images of an adult nature and enter contests without parental or guardian permission.
Subscriptions; Charges on Your Billing Account.
Yogift.com does not make a charge to an agent or Business Organisation in the event that it successfully employs a registered member applicant and Yogift.com will not, does not charge a fee or take commission from a registered member applicant who has secured work or an investment, signed contract from the provision our website Service.
Membership Subscription: The membership fees payable in respect of the Service shall be those fees as set out on the website registration page from time to time. We reserve the right to vary the fees in accordance with these terms and conditions.
Placing Contests: Recruitment Agents and Business organizations will have to a fee to use this service. We shall send an invoice to you and expect 70% payment in advance. You agree to pay Yogift.com the remaining 30% after the agreed contest period is complete.
Recurring Billing: Yogift.com Subscription plans run quarterly, 6 months and 12 months respectively during registration. If you do not cancel the subscription, the subscription will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation.
Price Changes
We reserve the right to increase fees or introduce new prices or charges at any time.
Refunds
You have the right to cancel your membership with Yogift.com and claim a refund within 7 days of your first subscription payment to Yogift.com. A 50% administration fee is charged for processing each refund.
After 7 days if you cancel your membership you will be entitled to no refund this applies to members and Agents or Business Organisations.
Viruses
Although we take reasonable steps to prevent the introduction of viruses or other destructive materials to our website or on-line service, we do not guarantee that the service or materials that may be available from our website do not contain such destructive features. We shall not be liable for any damages or liability attributable to such features. If you use any materials available through this website, you do so solely at your own risk.

We Yogift.com shall try to make sure our website is accessible all the time but due to unforeseen situations website may be interrupted, restricted or delayed we shall not be liable for damages or costs. By accepting this agreement we acknowledge you have understood and accepted all Yogift.com terms and conditions, Yogift.com service terms and conditions and Private policy.
Law and jurisdiction
Yogift.com website is governed by and construed in accordance with English law, and any disputes relating to these terms of use shall be subject to the non-exclusive jurisdiction of the courts of England. Any dispute arising in relation to these terms and conditions and any agreement arising from our website will be heard in England and resolved in accordance with English law.
In addition, we may bring proceeding against you in any jurisdiction in which you are resident, domiciled, have assets, or are incorporated, and you unconditionally submit to all such jurisdictions.

As part of Yogift.com website you can register on line and sign up to apply to take part in various contests advertised, apply for various talents advertised, submit or upload your own original work. When you register to use Yogift.com service, there are extra terms and conditions that you need to act in accordance with.
Inaccurate Information
All information provided to us must be complete and accurate information. If your information changes you will be responsible for providing us with the updated information. We shall not be held liable for any loss, damage or consequences as a result of inaccurate or incomplete information we receive from you.
Your membership profile and details
You are responsible for any use of our on-line service with your password and protecting your password from unauthorised use. You are also responsible for the security of any computer where you choose to remain signed in to Yogift.com

Yogift.com Service may provide, or third parties may provide, links to other World Wide Web sites or resources. We Yogift.com has no control over such sites and resources, you acknowledge and agree that Yogift.com is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that Yogift.com shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance upon, any such Content, goods or services available on or through any such site or resource.
Member contact and Profile
You agree that when you make your profile public or include your portfolio, Videos, photo or pictures, contest entries in the Yogift.com database directory that Yogift.com will publish your personal information and Videos, portfolio, photos or pictures, contest entries and allow other members to contact you or Agents/ Business organizations. You also agree that you will not use the contact system to send junk mail, spam, offensive messages, or for any purposes other than those directly related to talent, or recruitment opportunities, auditions, further information with regard to Agent/ business organisation or advertised contests. Yogift.com will be the sole judge of any breach of the conditions of use. Any breach of these conditions can result in your membership being terminated and a permanent ban from Yogift.com website. No refund will be given if you have breached the conditions of use.

You may instruct us to provide you with any personal information we hold about you. Provision of such information may be subject to the payment of a fee (currently fixed at UK£10.00).

Collects personal information about you through your use of the services and the web site, including your registration details; and information relating to your use of the Yogift.com web site, the content you access, and any messages you send. You also agree when you choose to make your profile public or include your Videos, portfolio, photos or pictures, contest entry in the Yogift.com database directory that Yogift.com will publish your personal information and Videos, portfolio, photos or pictures, contest entry, and allow other members to contact you or Agents/ Business Organizations. You have the ability to access and correct your personal information at any time by accessing your account profile.
We will not sell or allow third parties to access your personal information without your consent, however you agree that Yogift.com may disclose your personal information, including your name and contact details, to the relevant authorities, parties and/or the applicable intellectual property right holders (or their representatives) Where the law requires us to do so.
